Which of the following statements regarding counter-offers is correct?
A Counter-offers may be accepted by the original offeror
B Counter-offers do not terminate the original offer
C A statement that enquires whether alternative terms would be acceptable is a counter-offer
D A counter-offer is made by the original offeror to the original offeree.
1. Could you explain why the answer is A and not C?
When an offer is received and the offeree makes a counter offer, the effect is to destroy the original offer and replace it with a new offer
That means that the person that made the original offer is now the offeree and can accept this counter-offer
An enquiry about the possibility of revision of terms in an offer is simply that … it’s an enquiry
