I have actually do have watched your but still have some confusion with the case of Chappel v Nestle.
Could you please explain what consideration did they give to each other?
The promise of a record (an old fashioned CD!) called “Dancin’ Shoes” to anyone in exchange for 1 shilling and 3 pence (old money) and 3 wrappers from the chocolate bars called “Five Boys”
Chappell, the distributors of Dancin’ Shoes claimed that Nestle were selling the record for lower than the minimum price (2 shillings and 1 pence old money) but Nestle claimed that 1 shilling and 3 pence PLUS the 3 chocolate wrappings was equal to that minimum retail price
Chappell said “How can that be? Nestle throw away the wrappers and don’t even count neither the money nor the wrappers, but the Court came out with the memorable quote “A peppercorn has a value and even though the recipient doesn’t like pepper and throws away the corn, it still has a value”
