    Sir you said my typing of question 2 was incorrect, I could not understand. Also I have confusion in breach of representation and breach of condition. Please clear me in the following

    In breach of representation innocent party can claim
    Either
    a) Rescission of contract + damages
    Or
    b) only damages

    Any 1 between a and b. Right?

    In breach of condition innocent party can claim
    Either
    a) Termination of contract + damages
    Or
    b) only damages

    Any 1 between a and b. Right?

    My reply to your original question that I posted at 18.30 on 27 December said this:

    “a) rescission and / or damages when one suffers from a mis-representation

    b) termination of contract and damages (if term is a condition), and

    damages if term is a warranty

    OK?”

    That answers all your questions!

    Your most recent post … this one … is incorrect and is not a correct interpretation of my original answer

    This is wrong:
