Dear Mike
Please help to clarify:
In relation to the United Nations convention on Contracts for the International Sale of Goods , which of the following statement/s are true?
1 The parties may state that the Convention does not apply to their contract
2 The parties cannot amend the effect of any specific clauses
A 1 only
B 2 only
C both 1 and 2
D neither 1 and 2
Correct answer A
I have fully understood the option 1, however the option 2 is not completely clear.
Could you kindly explain it to me.
Thanks a lot for your help
Gabbi
Ask yourself, is it true that the parties are prevented from tweaking the effect of any clauses from within the CISG to tailor them for their own contract. No! They can tweak them and therefore option 2 is not true
These questions are tricky when there are negatives thrown into them “Is it true that they cannot ….” or even “Is it false that they cannot ….”
Ok now?
