    Principle: When one party has commenced a course of action but has not yet completed it, the other party cannot withdraw their offer

    There’s absolutely no chance of that happening, sorry! That’s the point of having the blank page for you to complete for yourself – it’s the only really effective way of learning the subject!

    Bigg later changed his mind and said “I don’t want to sell”

    Court ordered that there was a valid contract “I accept your offer” so specific performance was ordered and Bigg had to sell

    Interesting that there appeared to be no written contract whereas I have always understood that English law required a contract for sale / purchase of property had to be in writing

    I checked up on the internet about this and it seems that the general principle is correct – a contract for the sale of real estate should be in writing

    However, I happened upon an article (here’s the link – https://en.wikipedia.org/wiki/English_contract_law) and got sucked into it!

    I really enjoyed reading it and have to thank you for motivating me to look again at some old favourites 🙂 even though Bigg v Boyd Gibbons doesn’t feature within that article

    1.retrospectively
    2.ostensible authority
    3.by estoppel
    4. Apparent

    No problem … but this has nothing to do with the original post on this thread – titled “Case law”

    So I’m going to ask you to post this again with an appropriate heading and ask also that, in future, whenever you have a question that is a new topic, please start it in a new thread.

    That way any other student will not be misled and one that wishes to know more about expressions in agency will know where to look!
