hello sir.as u know in examiner’s answer for f4 are more than required.so please give me a typical answer which is required by a student in the f4 exam.
what will u write in 18 minutes to earn 10 marks in both a scenario and knowledge question.lets consider these 2 following question.please solve them sir for me to have an idea and thank u very much for your time and help.
question 1
Abid regularly took his car to be serviced at his local garage, Bust Ltd. On the four previous occasions, before handing
his car over to the garage, Abid had always been required to read and sign a contractual document which contained
the following statement in bold red type:
‘Bust Ltd accepts no responsibility for any consequential loss or injury sustained as a result of any work carried out
by the company, whether as a result of negligence or otherwise.’
On the most recent occasion, due to the fact that the garage was very busy when he arrived, Abid was not asked to
sign the usual document. He was, however, given a receipt for the car, which he accepted without reading. Bust Ltd’s
usual business terms were printed on the back of the receipt, including the statement above.
On driving the car home after its service, Abid was severely injured when the car suddenly burst into flames. It
subsequently emerged that the fire had been the result of the negligent work by one of Bust Ltd’s mechanics. Bust
Ltd has accepted that its mechanic was negligent but denies any liability for Abid’s injuries, relying on the exclusion
clause above.
Required:
Advise Abid:
(a) whether the exclusion clause was incorporated into his contract with Bust Ltd; (7 marks)
(b) as to the possible impact of the Unfair Contract Terms Act 1977 regarding any claim Abid might make
against Bust Ltd in relation to his injuries. (3 marks)
(10 marks)question 2
In relation to the formation of a company explain:
(a) the role and duties of promoters, and how they are regulated; (5 marks)
(b) a pre-incorporation contract, and its legal consequences. (5 marks)
(10 marks)May 22, 2014 at 10:59 am #170075Hi
Rather than ask me to answer past exam questions, may I suggest an alternative approach that you may find useful.
Open the revision kit at the answer page to these two questions and read each sentence / paragraph. Select what you consider to be the main point within that sentence / paragraph and collect together 10 such key matters.
That should then be the base for your answer.
Note the style of answering such questions.
Identify the area of law
Define any expressions that you feel are appropriate
Expand the ideas from those definitions quoting cases (if you can) to illustrate the points
Apply the expanded ideas to the scenario and reach a conclusion
I hope that that proves to be helpful but, I’m sorry, there is no way that I an going to type out 2 suggested answers!
🙁
