What are the liabilities of an agent
Hi Mellinda,
Generally an Agent is NOT personally liable. The very nature of agency law means that the contract is ultimately between Principal and Third Party. Agents are said to act without personal liability.
However, there are exceptional circumstances when they become personally liable. If you listen to the recording and read through the study text you will hear that the Agent becomes personally liable if they sign contracts in their own name, the third party does not know they are acting as an agent or if they lack authority.
