which agency relationship is made retrospectively?
Where a person purports to act as an agent but is acting beyond his / her authority. When this comes to light (probably when the third party seeks to perform in accordance with the ‘contract’ entered into through the agent) the ‘principal’ is able to state either that the agent lacked authority (and may thus avoid any liability on the contract) or may alternatively choose to approve the contract and thus affirm the agent’s position retrospectively
