November 17, 2023 at 6:53 pm #695023The statements seem contradictory…
The exact time of receipt or payment Dosen’t have to be known v/s the contract speicifies predetermined date in future for purchase or sale.

October 17, 2023 at 10:37 am #693589Thats exactly what I’m asking how is the tax shield minor at 25% compared to systematic risk of only 10.4%?
October 15, 2023 at 9:08 pm #693335I’m sorry but the answer mentions that the tax shield is only minor compared to risk premium, if you see the original question upwards the option C) just says tax saving
And D) says systematic risk. If the systematic risk is 10.4% as calculated above how is tax shield minor compared to it can you calculate ?October 14, 2023 at 6:51 pm #693199Hello John, the tax shield for this question would be 25% which is greater than risk premium (systematic risk) of 10.4% why does the kit state the tax shield is only minor compared to systematic risk? If there’s Seth wrong with tax shield would you pls explain? Thankyou-

However, in Sidebottom v Kershaw Leese & Co (1920), an alteration to the articles to give the directors the power to require any shareholder, who entered into competition with the company, to sell their shares to nominees of the directors at a fair price was held to be valid.August 21, 2023 at 8:34 am #690367It appears I made a mistake sorry C and D are correct answers. I understand C is correct.
As to A I eliminated it, family agreements are presumed to have no intention to create legal relations unless rebutted so wouldn’t be a contract in the first place for the court to overlook the formal requirements!
As for D, now. I’m gonna paste the answer here
Agreements between family members are difficult to understand as contractually binding, owing to the motive behind the actions undertaken or promise made. This looks very much like a standard family understanding that when grandparents visit, Marion likes the house to be tidy.
Can you explain now why is it D?August 20, 2023 at 6:25 pm #690344Oh Thankyou?
