Greetings Tutor hope you are doing well..
In relation to the Legal System of England and Wales, which of the following are subject to the doctrine of Sovereignty of Parliament.
a) Statutory Instruments only
b) Acts of Parliament only
c) Both Acts of Parliament and Statutory Instruments.
The correct answer has been mentioned as “Option B”. Can you please tell me why Statutory Instrument are not subject to the Doctrine of Sovereignty of Parliament. There is no explanation in the answer section so I hope you can possibly help me.
Looking towards an early reply Thankyou.
Statutory instruments are primarily delegated to the minister responsible. However! The minister’s decision / actions are nevertheless subject to parliamentary sovereignty.
I am therefore as confused as you are by the printed solution anduggest that option C would be preferable.
