Avon delivered some animal feed to Abram, who owned a poultry farm under the UN Convention on Contracts for the International Sale of Goods it was subsequenty discovered that the animal feed was contaminated due to inadequate packaging rendering it toxic for most animals. However the chicks on Abram’s farm were not affected.
For each of the following statements regarding Aron’s obligation as seller, state whether it is true or false.
True False
Avon has conformed to the contract as Abramn’s chicks were not affected by the contaminated feed false ( since they were not fit for the usual use of it)
Aron was under an obligation to adequately package the feed true
Plz let me know if my answer is correct
April 1, 2022 at 5:18 pm #652533Again, Safiya, the answer’s in the book! I assume that you disagree with the printed solution because otherwise you wouldn’t be writing to me. So what does the book answer say?
On the face of it, it looks to me like your answers are correct
But here’s a couple of issues for you to consider:
are the goods not fit for their usual use if their usual use is as chick feed, and they were used as chick feed and the chicks were not harmed? and
how would anyone know that the chick food was toxic for other animals if it’s chick food and it isn’t toxic for chicks? and
how would Abram know that the animal food was toxic? He fed it to his chicks and they were fine!
Silly question!
