“It appears that Moosewood Hospital Co is storing and possibly using medicines which have passed their recommended use by date. This may be illegal, it may breach the terms of agreement with their suppliers….”

ma’am how does use of expired pills by the hospital lead to breach in agreement with suppliers? I just find this argument totally misplaced! can you shed some light on this ma’am?

You have presumably come across “best-before” and “sell-by” dates – if not, browse the internet https://www.food.gov.uk/safety-hygiene/best-before-and-use-by-dates

    Here https://www.bromley.gov.uk/leaflet/122624/3/757/d for example:

    “Conditions of sale
Foods marked with a use-by date must not be sold or displayed for sale after their marked dates. It is an OFFENCE to sell or offer for sale food past its use-by date.”

Retailers can be fined and/or prosecuted for breaching standards.

It is not then such a leap to imagine (even if you do not know) that in many countries, there is a lot of regulation and control over the supply of medicines, etc. (Also “best practice” – for example, encouraging consumers to take out-of-date meds to pharmacies for safe disposal (not to discard with household waste as this has risks).)

So a drug supplier may well require a customer to return out-of-date supplies (or dispose of in some specific and certifiable way) – not only to protect public health but to reduce the risk of reputational risk to the supplier (imagine if a large quantity of medicines discarded in landfill were to contaminate a water supply ….)
