Good day sir , lm finding difficulties in understanding the tax ties, for instance the following question is an extract from the Kaplan kit and personally l had thought that the correct answer is three ties but unfortunately its not. the correct answer is “C” that is two ties and l do not understand how. kindly assist

Samuel is planning to leave the UK to live overseas, having always previously been resident in the UK. He will not automatically be treated as either resident in the UK or not resident in the UK. Samuel has several ties with the UK and will need to visit the UK for 60 days each tax year. However, he wants to be not resident after he leaves the UK. For the first two tax years after leaving the UK, what is the maximum number of ties which Samuel could keep with the UK without being treated as resident in the UK?A One

D ThreeJanuary 30, 2020 at 8:13 am #560195This is probably an issue of not fully understanding what the question has actually asked you – a usual problem for students with objective testing questions!
The question asks:
“What is the maximum number of ties which Samuel could keep with the UK WITHOUT being treated as resident in the UK?”
When you refer to the table provided you see that someone who was previously UK resident with 60 days in the UK WILL be resident if they have 3 ties – your answer – BUT therefore the maximum number of ties WITHOUT becoming UK resident must be 2!January 30, 2020 at 2:58 pm #560215ohh now l get it sir, thank you very much,

One of the 5 UK ties-“house in UK which is used during tax year”, does the “used” here mean used only by the owner, or by anyone (ie as long as the house is in use)?Thanks for answering the question.
