Hey,
The question is; which part of a courts decision is binding on later similar cases?
a. ratio decidendi
b. ultra vires
c obiter dicta
d stare decisis
My answer was A. I thought ratio decidendi is the rational reason behind the court’s decision and ratio decidendi of a case binds all the lower courts on similar cases later on.
But the correct answer was B. I don’t understand why as in my knowledge the meaning of that phrase is acting beyond powers. May you help me, please?
Hi @tugcem,
The correct answer is A. Ratio decidendi
If you see the comments below the chapter 1 Practice Questions, there the Tutor has indicated this.
Hope that helps.
Thanks Jetavi – this incorrect answer in the tests is, in just a matter of days, being corrected
