If a buyer tells the seller that they will not pay for the goods and the delivery of goods is scheduled at a later date as per contract. Is this an anticipatory or fundamental breach?
This is one question from bpp revision text. Though the explataion is provided O didn’t really get it. In one line it says its anticipatory and in the other it says its fundamental.
I would have said that this was anticipatory – it’s the notification of breach in advance of the due date for performance
