Sir in Bpp and wikepida its written that consideration must pass from promisee, although consideration must pass from both parties na i.e promisor and promisee?
“in Bpp and wikepida its written that consideration must pass from promisee”
It doesn’t say that the ONLY consideration must pass from the promisee
The point being made by BPP and wikipedia is that, where there is a dispute between two contracting parties, the only claimant is the one that has paid the consideration
That means that some other party that has not paid any consideration is unable to claim damages in a contract where that person was not directly involved
It’s the fundamental principle of the doctrine of privity of contract
But, of course, there are exceptions (Donohue v Stevenson always brings a smile to those who know about the case)
OK?
