Sir, where casual link is broken due to intervening act ( e.g, act of 3rd party, act of claimant, natural disaster) in all these cases then defendant will not be liable for any loss caused after intervention OR will he not be liable for any loss caused even before intervention? In other words, I mean to ask that defendant will not be liable for the INCREASED loss OR will he also not be liable for the ORIGINAL loss?
Will escape liability for the increased loss .. but it is probably impracticable to try to separate the loss suffered into pre- and post- novus actus
It’s very much an impractical hypothetical situation that you’re trying to create here!
