1.Could you explain why specific performance is not applicable for employment.
2. What’s the difference between specific performance and action for price?
Both seemed ordering the party in breach to perform their side of the contract.Thanks.
1 – how can anyone control the quality of performance? If David Beckham were to be ordered to play for LA Galaxy against his wishes, what is to stop him standing motionless in the centre circle?
That’s why specific performance will not be ordered against an individual
“Specific performance ” is a remedy granted at the Court’s discretion
“Action for price” is the cause of action taken by the plaintiff
They are at opposite ends of the life of a case taken through the Court system
OK?
