Hi Mike.
After appeal, Mr Jarvis of Jarvis v Swan Tours was awarded £125 in damages. He originally paid about £63. (source wikipedia). I presume the final compensation also included his legal costs up to the appeal. My question is how did the courts ascertain ‘how much’ to compensate him for ‘mental distress’?

Well! That’s a burning question isn’t it? And the damp squib of an answer must be …. “Who knows?”
I have no real idea but what about this as a possibility … how much would it cost Mr J now *Court decision day) to go on an equally pleasurable holiday as the one that was such a disaster and use that cost as a basis for the calculation of the measurement of damages
