An auditor’s employment contract with an audit company is not renewed because the company is being winded up by its partners. ( The auditor is qualified and honest. )
/*The auditor didn’t make any mistake, so why is this a fair dismissal? */
If I understand your question correctly it is because such a situation would be redundancy and not unfair dismissal.Redundancy applies to a dismissal if only or main reason dismissal occurred is that the employer is going to stop carrying on business or has done so already.Alternatively, if requirement of business to carry on work carried out by employee has stopped or been reduced or is expected to stop or reduce.
Thanks, I think you are right.
You are welcome.
