Question no. 2 asks: Which part of a Court’s decision is binding on later similar cases?
The answer selected in this forum is ‘Ultra Vires’.
I understood ‘ultra vires’ to mean ‘acting without legal authority’, which has nothing to do with a Court’s decision.
Could you please re-examine the answer chosen for the question?

April 3, 2016 at 3:26 pm #308906The ratio decidendi is the vital part of the decision taken by the court. It is the principal reason for the court to rule the way it did. This is the part of the decision that binds lower courts.
