This question was in the mock test:
Under the Bribery Act 2010 which one of these is not an offence?
Answer: as a person of overseas origin living in the country of your birth, offering a bribe to a representative of a British company on the occasion of their first visit of your country
Why would this not count as bribery? I can only think that because it is a visit to the country and not a business transaction/business related deal it doesn’t apply?

July 16, 2015 at 3:40 pm #260935Some may do, some may not! I have no idea. Well, I do, but not all countries have effective anti-bribery laws. You only have to live a few days in some countries before you realise that corruption at the highest level trickles easily down to the lowest levels. Good old’ Hamlet is reported to have said “There is something rotten in the state of Denmark”
Well, Hammy’s comment (whilst not necessarily appropriate to Denmark these days) could equally well be appled to many, many other countries
July 16, 2015 at 4:00 pm #260938I have heard stories about instances in certain countries where people have turned a blind eye to things for a small amount of cash and other forms other bribery that have occurred. However if there are countries that do not have any laws on it that is diabolical.
Although as you have said even if the countries do have them they may not always be effective. At least I know the answer now though for the exam that the Bribery Act only applies to UK nationals.Thanks
July 16, 2015 at 4:17 pm #260941You need to get abroad more! There are European countries where policemen expect a payment when they stop you – whether or not you have done anything wrong! I’m thinking of one that I have driven through 6 times where the police have the reputation (I have no proof that this is true) whereby, if they stop you, they will walk slowly around your car. If they complete three rotations, then you’ll get a ticket so you have that time available whilst they walk around your vehicle to get your wallet / purse out
July 16, 2015 at 5:21 pm #260946I have been to a few European countries but I do not drive. I have preferred my holidays in America. The majority of the stories I have heard about have involved the police.
However a lot of the bribery and corruption tales that I have heard about have taken place in South Africa.Never heard of the walking around the car thing, does that mean they can’t get in trouble because they never asked for the cash? Silly question given that who are they going to report it to…the police?!
