Hi,
I recently purchased some practice tests on the MyACCA website and one of the questions (below) doesn’t quite make sense to me, am I misinterpreting the question, answer or have the ACCA made a mistake here? As I read what their explanation for the correct answer should be it seems to contradictory.
Which of the following statements about specific performance is NOT true?
It can be ordered where the court can supervise the order
It can be granted at the court’s discretion
It is not available where an injunction would be a more appropriate remedy
It can be ordered where damages would be inadequateCorrect Answer
It can be ordered where the court can supervise the orderSpecific performance will only be granted where the common law remedy of damages is insufficient to compensate a claimant. It will not be available in cases where the court would have to supervise compliance. All equitable remedies are granted only at the court’s discretion.

March 24, 2015 at 11:21 pm #238630Thanks Mike! I think it’s a good example of just how difficult the examiner makes these cbe questions. It’s really important to make sure you read and understand what is being asked. I found many of the cbe exam questions just confusing and structured in a way that can have you misinterpreting the requirement especially under exam pressure.
