Hi Mike, I don’t really understand the measure of damages when a construction contract is breached. My kaplan text stated that “the cost of remedying the defects are disproportionate to the difference in value between what was supplied and what was ordered. ( please can you explain this in simple english)
please can you explain how damages are measured and with regard to Ruxley Electronics and Contsruction ltd vs. Forsyth
The cost of draining and deepening and rebuilding a pool far outweighed the loss of amenity ( pleasure ) so damages were measured on the proportionate basis of the “missing volume” compared with contracted volume
