Hi Mike!
Concerning tort and professional negligence,
1.could you explain who owes a duty to who?
2. Auditors owes a duty to who?
3. professional owes a duty to who?
4. What are the general rules and exceptional rules?
Thanks.
Too much!
We ALL of us owe a duty of care to those that are affected by our actions (our legal neighbours)
When driving your car, you owe a duty of care to other road users
Auditors owe their professional duties of care to their client companies
A professional owes a duty of care to all those affected by that professional’s actions
Who are our legal neighbours? Those people that are so directly affected by our acts that we should have had them in mind as likely to be affected when we committed those acts
Enough?
