    Can a party discharge the contract and claim damages when there is a breach of condition? Can they not discharge the contract when it is a breach of warranty, but can they claim damages?

    How can I distinguish between a condition and a warranty?
    How can I know what changes the contract and what is just a minor detail?

    Even without the “couple living together” presumption, there was no consideration from her anyway, was there? Seems like it was a one-sided promise from the man. The woman could not be bothered going back to Sri Lanka because she was feeling better in Kent. That can’t be consideration. So no consideration AND no intention to create a legal relationship. The guy is still a pillock regardless.

        Today was my exam. And it was a coincidence that in the exam i came across a question in which a company advertised claiming 100% cure for cold and showed how their product was to be used.

        It was exactly like the carbolic smoke ball and i remembered it.

    “Balfour you cheat,I knew I shouldn’t have trusted you” poor Mrs balfour didn’t even get her 10 pounds and lost the cheat of a husband to some Sri Lankan mistress. Just checking in today again Mike and as usual thanks for the lectures.

    Could you please explain what ‘binding in honour only’ means?

    I understand that this clause excludes an intention to create legal relations but I do not know the rationale behind it.
